Past and Future Medical & Rehabilitation Expenses PDF Print E-mail

In motor vehicle accident cases, medical and rehabilitation expenses are payable during the initial 10 years after the accident up to a maximum of $100,000.00. If the claimant has suffered a “catastrophic injury”, claims may be made for the lifetime of the claimant up to a maximum of $1,000,000.00. No claims for past and future medical and rehabilitation expenses may be made against a tortfeasor unless the claimant has suffered a catastrophic injury, or meets the threshold for claims for non-economic damages.

In non-motor vehicle cases, the tortfeasor is responsible for all medical and rehabilitation expenses of the claimant, without deduction. The claimant must establish that the treatment expense is reasonable and incurred as a result of injuries sustained in the accident.
